We strive to provide our guests with an exceptionally clean, safe, and friendly experience. The following Terms and Conditions have been established based on industry standards, management and operational procedures. These Terms and Conditions are considered a part of our reservation agreement with you. As our guest, by reading and signing your property registration you are agreeing to abide by all our Terms and Conditions, rules, and procedures. These Terms and Conditions are presented here to help promote our guests’ safety and enjoyment and to ensure that each guest is aware of the understandings between Casa Viva Lodge and the guest. Our Terms and Conditions may change from time to time, so please check back often.

Casa Viva Lodge will maintain any and all information regarding our guests’, private to only our facility. The information entered into the site will not be provided to any other source. This information will be used solely by Casa Viva Lodge.

We require valid contact information from the guest making the reservations, including first and last name, address, phone number, and signature.  The names of all guests occupying the room must be registered. Information regarding your license plate/car description is also gathered at check-in for security.

Guests must be at least 18 years of age to check in at Casa Viva Lodge.  In the interests of security and to prevent fraud, guests are required to confirm their identity by providing their valid government issued photo identification (State driver’s license, passport, etc.) at check-in.  A valid, signed, and pre-approved credit card in the name of the registered guest is also required.  It is your responsibility to fully understand the manner in which your bank processes pre-authorizations and charges your credit/debit card.  Some banks hold pending authorizations for up to 30 business days.

All rates are quoted in United States currency, plus tax.  Rates may increase without notice.  Rates as advertised on the Casa Viva Lodge website or any other website or promotional material are subject to change at any time and may increase or decrease at our discretion.  Rates are based on standard room occupancy (duplex room 3 pers, Apt 3 pers and Villas 5 pers) and are subject to availability.

Casa Viva Lodge is privately owned and operated. We reserve the right to refuse service to anyone for any reason(s) that does not violate local laws. Casa Viva Lodge has a zero tolerance policy, we will refuse to admit or refuse service or accommodation in our property or may remove a person, without refund, who refuses to abide by the reasonable standards and policies established by the Government of Costa Rica and the owners for the operation and management of the property. Casa Viva Lodge will refuse service or evict a guest for: refusal or failure to pay for accommodations, is under the influence of alcohol, drugs, or any other intoxicating substance and acts in a disorderly fashion as to disturb the peace of other guests or is not in compliance with local laws; is unable to properly supervise their children at all times, seeks to use the property for an unlawful purpose; seeks to bring into the property: an unlawfully possessed firearm; or something, including an explosive or hazardous or toxic substance, that is unlawful to possess and that may be dangerous to other persons; destroys, damages, defaces, or threatens harm the property or guests; causes or permits persons to exceed the maximum allowable occupancy of room, refuses to abide by the reasonable standards or policies established by Casa Viva Lodge for the operation and management of our property

Children aged 12 and under stay for free when sharing a room with one or more paying adult(s), using existing bedding.  As the parents, guardians, or chaperones of children you are personally and legally responsible for and must supervise them at all times. For safety reasons, please do not leave children unattended in guest rooms or allow them to roam the property unsupervised.

All vehicle(s) must be listed on the registration at check-in.  Parking for registered guest(s) is free.  All vehicles are parked at the risk of the owner. Casa Viva Lodge shall not assume liability or responsibility for any vehicle, occupants, or contents while operated or parked on the property. If a vehicle is left in the property parking lot after the guest has departed without the written consent of Casa Viva Lodge, we reserve the right to have the vehicle towed at the owner’s expense. No vehicle repairs on property premises. 

You are liable for any damage howsoever caused (whether by a deliberate, negligent, or reckless act) to the room (s), property premises or property caused by you or any person in your party whether or not staying at the property during your stay. Casa Viva Lodge reserves the right to retain your credit card and/or debit card details as presented at registration and charge or debit the credit /debit card such amounts as it shall in its sole discretion deem necessary to compensate or make good the cost or expenses incurred or suffered by Casa Viva Lodge as a result of the aforesaid.  Should this damage come to light after the guest has departed, we reserve the right and you hereby authorize us to charge your credit or debit card for any damage incurred to your room or the property during your stay, including and without limitation for all property damage, missing or damaged items, smoking fee, cleaning fee, guest compensation, etc. We will make every effort to rectify any damage internally prior to contracting a specialist to make the repairs, and therefore will make every effort to keep any costs that the guest would incur to a minimum.

Guest Rooms found with waste strewn around, in complete disorder, and/or “trashed” will be subject to a maintenance deep cleaning fee, administration fee and/or third party fees.

Damage to rooms, fixtures, furnishing and equipment including the removal of electronic equipment, towels, art work, etc. will be charged at 120% of full and new replacement value plus any shipping and handling charges. Any damage to the property, whether accidental or willful, is the responsibility of the registered guest for each particular room.  Any costs associated with repairs and/or replacements will be charged to the credit card of the registered guest.  In extreme cases, criminal charges will be pursued.

Damage to mattresses and linen including; towels, mattress pads, sheets, bedspreads, and blankets resulting from the use of body oils, make-up, shoe-polish, mud, etc. will result in a charge for the special cleaning, repair or replacement of the damaged article.

Casa Viva Lodge reserves the right to take action against any guest or visitor found to have tampered or interfered with any detection equipment throughout the property, including detector heads in public areas, guest rooms, break glass points and fire extinguishers. Guests or visitors found to have tampered with any fire detection or fire-fighting equipment will be charged with any costs incurred by Casa Viva Lodge due to their actions and will be evicted from the property. Depending on the severity of the guest’s actions, law enforcement may become involved at Casa Viva Lodge’s discretion. Should the fact that fire-fighting or detection equipment had been tampered with come to light after the guest has departed, we reserve the right and you hereby authorize us to charge your credit or debit card for any damage incurred to your room or the property during your stay, including and without limitation for all property damage, missing or damaged items, smoking fee, cleaning fee, guest compensation, etc.

Casa Viva Lodge reserves the right to amend, modify, change, cancel, vary or add to these Terms and Conditions or the arrangements and content featured on our website at any time without prior notice.  Please check our website regularly for updates to Terms and Conditions. Any modification to these Terms and Conditions that occurs before your departure is considered a part of your reservations’ agreement with us. A copy of these Terms and Conditions is located on our website and available from Front Desk staff upon request.

Booking Notes:

  • All rates are per room, per night and are subjected to government taxes
  • All amounts related with bookings have to be paid within 24 hours after booking time
  • Free Wi-Fi
  • Snorkeling equipment, bicycles, kayaks and surf boards are available for rent on site
  • Kids 12 and older pay as an adult
  • All rooms are non-smoking
  • Check-In: 3pm
  • Check-Out: 12 noon. If you require a later check-out, please contact Front Desk prior to the day of your departure and we will do our best to accommodate your request.  A charge may apply for late check-out.

Reservation Policy:

Dec 15 to Jan 15 / Eastern Week

  • 100% of stay is due when the reservation is done, non-refundable.

HIGH SEASON (Jan 15 to May 15 / Sept 1 to Oct 31)

  • 50% of payment is due when the reservation is done, non-refundable.
  • Full payment is due 30 days prior to arrival.

LOW SEASON (MAY 16 to Aug 30 / Nov 1 to Dec 14)

  • 50% of payment is due when the reservation is done or 30 days prior to arrival.
  • Full payment is due 15 days prior to arrival.

Cancellation Policy:

After submitting request in writing, the following policies apply:

Dec 15 to Jan 15 / Eastern Week

  • 100% non-refundable.
  • No-shows and early departures will be charged at 100%.

HIGH SEASON

  • 100% non-refundable.
  • No-shows and early departures will be charged at 100%.

LOW SEASON

  • If a reservation is cancelled 30 or more days before the arrival date, there will be no charge.
  • If a reservation is cancelled 29 to15 days before the arrival date, 50% of the total reservation will be held as credit for a future reservation, subject to availability and rate change. If a reservation is cancelled 14 days or less before arrival date, 50% of the total reservation will be charged and the other 50% will be held as credit for a future reservation, subject to availability and rate change.
  • No-shows and early departures will be charged at 100%.

Credit card will be charged in total at the moment of making the reservation.

TERMS AND CONDITIONS FOR THE USE OF EQUIPMENT AND FACILITIES

Casa Viva Eco Lodge SRL, affiliates, owners, employees, managers, agents or other associated personnel, hereby constitute and warrant to the Client the following statements of facts:

  1. Kayaks, paddle boards, surf boards, bicycles, snorkeling and fishing gear and any other recreational equipment for rent or at the disposal of Casa Viva Eco Lodge guests, should be considered a vessel or equipment for livery with a maximum capacity for 2 passengers or the maximum capacity indicated in the equipment specifications.
  2. The recreational equipment in Casa Viva Eco Lodge is for bicycling, touring navigation, surfing, snorkeling and fishery only. It is not equipped for any other activities such as water skiing, parasailing, aquaplaning or any other similar activity.
  3. Every guest or user of the equipment are required to wear protective gear and in the case of water activities a floating device at all times. The guest or user is responsible to comply with the local laws regulating these activities, including the transit restriction in the case of bicycles.
  • I UNDERSTAND THAT THERE ARE INHERENT RISKS INVOLVED WITH PARTAKING IN THE USE OF THIS EQUIPMENT, including but not limited to equipment failure, the perils of the sea, acts of other participants, and adverse sea and weather conditions, and I HEREBY ASSUME SUCH RISKS.
  • I UNDERSTAND THAT I HAVE A DUTY TO EXERCISE REASONABLE CARE FOR MY OWN SAFETY AND I AGREE TO DO SO.
  • I assert that I am physically fit to swim and ride any of the equipments at my disposal in Casa Viva Eco Lodge and I will not hold the Casa Viva Eco Lodge, affiliates, owners, their employees, managers, agents or other associated personnel responsible if I am injured as a result of ANY problems (medical, accidental or otherwise) which occur while renting or using any of the equipment at my disposal.
  • I fully understand that Casa Viva Eco Lodge does not have medical facilities and that in the event of illness or injury, appropriate care must be summoned by phone or radio and treatment will be delayed until I can be transported to a proper medical facility. I agree in advance to these conditions.
  • Casa Viva Eco Lodge SRL, affiliates, owners, employees, managers, agents or other associated personnel, have made no representations to me, implied or otherwise, that they or their personnel can or will perform safe rescues or render first aid. In the event I show signs of distress or call for aid, I would like assistance and will not hold Casa Viva Eco Lodge SRL, affiliates, owners, employees, managers, agents or other associated personnel , or third parties responsible for their actions in attempting the performance or rescue of first aid.
  • I agree to forever discharge and release Casa Viva Eco Lodge SRL, affiliates, owners, employees, managers, agents or other associated personnel, from any and all responsibility or liability for any and all injuries or damages. I agree NOT to make a claim against or sue any of the above parties for injuries or damages whether they arise or result from any NEGLIGENCE or other liability, EVEN IN CASES OF GROSS NEGLIGENCE. I further specifically agree, on behalf of myself, my heirs and assigns, to indemnify and hold harmless the released parties for any and all causes of action arising as a consequence of any incidents which might occur as a consequence of my participation in any bicycle, surf, kayak, paddle, boating, snorkeling and/or fishing activities with or involving the released parties.
  • I hereby constitute and warrant the following statements of facts to Casa Viva Eco Lodge SRL, affiliates, owners, employees, managers, agents or other associated personnel, the breach of which may cause severe damages to Casa Viva Eco Lodge SRL, affiliates, owners, employees, managers, agents or other associated personnel or to any of the equipment at my disposal for rent or use and or to third parties, which I hereby agree to indemnify as appropriate, namely:
  1. I shall and shall cause all the members in my group to observe all orders for safety, navigation and behavior from the personnel from Casa Viva Eco Lodge at all times.
  2. I shall not drink any alcoholic beverage in excess of the limits permitted by law regardless that I am not operating any of the equipment for rent or use at my disposal. I shall ensure that all the members in my group adhere to these rules.
  3. I shall respect the moral and ethical rules of the use of any equipment for rent or use at my disposal. At all times I and any member of my group shall be dressed up as appropriate. Nudity is not a dress code allowed during my rental or use of any equipment at my disposal.
  • I understand that Casa Viva Eco Lodge SRL, affiliates, owners, employees, managers, agents or other associated personnel may terminate the trip at any time during the rental or using period and that if such termination is due to the breach by me or by any of the members of my group of any of the representations and warranties and covenants made hereunder, I shall not be reimbursed for any unused time.
  • I hereby grant Casa Viva Eco Lodge SRL, affiliates and owners the irrevocable and unrestricted right to use and publish photographs, videos or other images of me or any member of my group or family, or in which me or any member of my group or family may be included, in any print, electronic, digital or other media; and to alter the same without restriction. I further acknowledge that my participation is voluntary and that I will not receive financial compensation of any type associated with the taking or publication of these images. I irrevocably assign such images’ rights and uses to Casa Viva Eco Lodge SRL, affiliates and owners into perpetuity. I hereby release Casa Viva Eco Lodge SRL, affiliates and owners and its legal representatives and assigns from all claims and liabilities relating to said images, videos or other media.
  • I declare that I read and understand English and fully comprehend and accept the entire document.

I HAVE READ THIS AGREEMENT, UNDERSTAND IT, AND AGREE TO BE BOUND BY IT, FOREVER INTO THE FUTURE.

understood the attached documents, that they are duly completed with the appropriate information and data, all in accordance with Articles 2, 3, 4, and 5 of Law No. 8454, the Law on Certificates, Digital Signatures, and Electronic Documents, as well as Article 2, Section 21 of the Regulation of said Law. The use of the aforementioned words or similar expressions implies digital acceptance of these documents.
